Terms of Service

1. Acceptance of Terms

By accessing or using the DozyTales website at dozytales.com, the DozyTales mobile application, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use the Service. DozyTales is designed for children aged 2–10, but all accounts must be created and managed by a parent or legal guardian.

2. Description of Service

DozyTales is an AI-powered bedtime stories platform that creates personalized stories and illustrations for children aged 2–10. The Service includes:

• AI-generated personalized bedtime stories featuring your child as the hero
• AI-generated watercolor-style illustrations accompanying each story
• Audio narration and audio-only bedtime mode
• Multiple adventure themes (space, pirates, fairy tales, jungle, dinosaurs, and more)
• Child profile management with age-appropriate content
• Story library for revisiting past stories

DozyTales does not display advertisements of any kind. We are committed to providing an ad-free experience for families.

3. Early Adopter Program

DozyTales is currently in a pre-release phase. During this period, we offer:

3.1 Waitlist

You may sign up for our free waitlist by providing your email address. Joining the waitlist does not obligate you in any way and does not guarantee a specific launch date or access priority.

3.2 Early Adopter Payment

For a one-time payment of $5, you may secure an Early Adopter spot. This entitles you to 3 months of the Basic plan (20 stories per month) beginning on the date DozyTales officially launches. Early Adopter spots are limited in quantity and available on a first-come, first-served basis.

The Early Adopter offer is a pre-purchase of future service. If DozyTales does not launch or the Service is discontinued before your 3-month benefit period is fulfilled, you will receive a full refund of your $5 payment.

4. Accounts & Profiles

4.1 Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4.2 Child Profiles

You may create one or more child profiles within your account. Child profiles allow DozyTales to personalize stories by incorporating your child's name, age, and interests. Only a parent or legal guardian may create or manage child profiles. We use this information solely to generate age-appropriate, personalized stories.

4.3 Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your access to the Service and any stored stories will be discontinued.

5. Subscriptions & Payments

5.1 Subscription Tiers

DozyTales offers the following subscription plans at launch:

• Free — 3 stories total. Includes basic themes and text story view.
• Basic ($9.99/month) — 20 stories per month. Includes all themes, audio narration, and audio-only bedtime mode.
• Premium ($14.99/month) — 45 stories per month. Includes all Basic features plus premium voices and priority story generation.

Annual billing options are available at a discounted rate. Prices are in USD and may be subject to applicable taxes.

5.2 Story Packs

In addition to subscription plans, you may purchase one-time story packs to supplement your monthly allocation:

• 5 stories for $3.99
• 15 stories for $8.99
• 30 stories for $14.99

Story packs do not expire and carry over regardless of your subscription status.

5.3 Billing & Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that date.

5.4 Price Changes

We reserve the right to change subscription prices. If we increase the price of your current plan, we will notify you at least 30 days before the change takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. Refunds

6.1 Early Adopter Refund Policy

If you purchased an Early Adopter spot, you may request a full refund of your $5 payment within 14 days of the official DozyTales launch date. No questions asked. After the 14-day window, Early Adopter payments are non-refundable.

6.2 Subscription Refunds

Monthly and annual subscriptions are generally non-refundable once a billing period has begun. However, if you experience a significant service issue, please contact us and we will work to resolve it or issue a pro-rated refund at our discretion.

6.3 Story Pack Refunds

Story pack purchases are non-refundable once any stories from the pack have been generated. If no stories have been used from a purchased pack, you may request a refund within 7 days of purchase.

6.4 How to Request a Refund

To request a refund, contact us at hello@dozytales.com with your account email and a brief description of your request. We aim to process refunds within 5–10 business days.

7. AI-Generated Content

All stories, illustrations, and audio narration provided through DozyTales are generated by artificial intelligence systems. You acknowledge and agree to the following:

• No guarantee of perfection. While we strive for high-quality, age-appropriate content, AI generation is inherently probabilistic. Stories may occasionally contain minor inconsistencies, unusual phrasing, or imperfect illustrations.
• Content filtering. We apply multiple safety filters to ensure all generated content is gentle, positive, and age-appropriate. However, no filtering system is 100% infallible.
• Unique but not guaranteed unique. Each story is generated uniquely for your child, but AI systems may occasionally produce similar narrative elements or themes across different stories.
• Parental oversight. We encourage parents and guardians to review stories, especially for younger children. If you encounter any content you find inappropriate, please report it to us immediately.

8. Intellectual Property

8.1 DozyTales Property

The DozyTales name, logo, branding, website design, app design, underlying AI models, software, and all proprietary technology are the intellectual property of DozyTales and are protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works from any DozyTales proprietary materials without our express written consent.

8.2 Generated Story Content

Stories and illustrations generated for you through the Service are provided for your personal, non-commercial use only. You may:

• Read, view, and listen to your stories within the app
• Share stories privately with family members
• Print stories for personal use within your household

You may not:

• Sell, license, distribute, or commercially exploit generated stories or illustrations
• Publish generated content in books, websites, or any public medium for commercial purposes
• Claim authorship or copyright ownership over AI-generated content
• Use generated content to train other AI models or systems

9. Acceptable Use

You agree not to use the Service to:

• Attempt to generate content that is harmful, violent, sexual, or otherwise inappropriate for children
• Circumvent, disable, or interfere with any content safety filters or security features
• Use automated tools, bots, or scripts to interact with the Service in an unauthorized manner
• Reverse engineer, decompile, or attempt to extract the source code or AI models underlying the Service
• Impersonate another person or create an account on behalf of someone else without their permission
• Use the Service in any way that violates applicable local, state, national, or international law
• Abuse, harass, or send unsolicited communications to DozyTales staff or other users

We reserve the right to suspend or terminate your account if we reasonably believe you are violating these acceptable use provisions.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory.
• DozyTales does not warrant that the Service will be uninterrupted, error-free, or completely secure.
• DozyTales shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
• Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you have paid to DozyTales in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

11. Changes to Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will:

• Update the “Effective Date” at the top of this page
• Notify you by email or through a prominent notice within the Service at least 14 days before the changes take effect

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you should stop using the Service and, if applicable, cancel your subscription.
